When Can I File an Asbestos Claim?

The legalities surrounding when a victim is allowed to file a claim in Alabama is quite confusing, especially in the wake of recent legal actions taken by the state. The short answer is that you can file a claim immediately upon being diagnosed as having mesothelioma or some other asbestos-related illness or injury, and that the sooner you retain an attorney and move forward with a lawsuit, the better your chances are of receiving monetary compensation.

The longer answer is that it depends on your particular case. If you are the victim and are filing a claim on your own behalf, you technically have one year from when you are diagnosed in which to file your claim. You need to make sure that you have all the backup evidence for your claim as possible from the start, including test outcomes and biopsy results. Once a year has elapsed, your right to claim is considered forfeit. In addition, if you were exposed to asbestos before 1980, your claims are likely to be disallowed, as the law states exposure had to have occurred after May 19, 1980.

A recent complication with regards to the statute of limitations in Alabama amended the law to say that those exposed to toxic substances such as asbestos must file within two years of exposure, but only after a diagnosis of mesothelioma or other illness has been made. This has placed a tight restraint on your options, as symptoms of your condition may take far longer than two years to show up. If you were exposed to asbestos twenty years ago, for example, but were only diagnosed with mesothelioma in the past year, your right to claim is currently considered forfeit under Alabama law.
